A--This is follow-on work for original order 775-J35007. Please assign PR to Joe Mendoza who is expecting this PR. For proper coordination with the field, the following individuals are assigned to this project and need to be

1. Agency and Contracting Activity Identification: The National Cemetery Administration (NCA) as directed by the Oakland Memorial Service Network Five, 1301 Clay Street, Suite 1230 North, Oakland CA 94612-5209 will enter into a contract that requires justification for other than full and open competition procedures. 2. Nature of Acquisition Being Approved: Award shall be made through other than full and open competition to Designed Engineering Fabrications INC, due to the continuing development of the unique nature of the procurement. 3. Description of Requirement: The awarded contractor shall provide design and manufacture, installation and testing of four prototype devices, that will be attached to the back of a Government provided Toro HDX (or Workman 3200/3300), to facilitate the transport and delivery of a single casket to the gravesite. Conceptual plans for this prototype are attached to this statement of work that detail the function of this device and will be used to assist in the design. The estimated cost is $19,730.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The Services are being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1(a) (2) ii. Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development. 5. The Nature of the Acquisition Requires Use of the Authority Cited: FAR Part 6.302-1. Competing this requirement will disrupt the continuity of the program to develop a new product that is not available in the commercial environment. Based upon the reasons stated above, this requirement is non competitive. Award shall be made to Designed Engineering Fabrications INC to continue the development of the Casket Transport Devices. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. None; the procurement is not available in the Commercial Market. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based upon parts pricing and labor provided to the VA National Cemetery Administration Engineering Section. 8. Results of Market Survey: Market research indicates that there is no other type of product that is available in the commercial Marketplace. There may be other companies that can provide similar services. However, the continuity of Data information will be compromise if another company participates in this acquisition. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? There are no other sources that have expressed an interest to date. However, the interim contract award will provide significant time to compete and award a long term contract. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is not anticipated that any subsequent requirement will be needed by the Government. 12.
