Notice of Intent to Sole Source for procurement of New X-Ray Tube for the Malvern Panalytical Axios Wavelength-Dispersive X-Ray Fluorescence Spectrometer

The U.S. Food & Drug Administration (FDA) intends to issue a Sole Source follow-on award to Malvern Panalytical for procurement of one (1) each new X-Ray tube for the Malvern Panalytical Axios Wavelength-Dispersive X-Ray Fluorescence Spectrometer. The Government intends to issue a sole source award in accordance with FAR 6.302-1, only one responsible source and no other will satisfy the agency requirements for the above stated service and in accordance with FAR 52.232-18, Availability of Funds. Malvern Panalytical is the sole source provider of factory parts, training, and services for all the Malvern Panalytical systems in the United States and Canada. This includes all service, preventive maintenance, parts, and calibration procedures developed by Malvern Panalytical for the Axios XRF spectrometer. No other company has the knowledge and rights required for the procurement of the x-ray tube. Previous award to Malvern Panalytical has been made for the service maintenance of the Axios XRF spectrometer, this award will cover for the installation terms associated with the procurement of the x-ray tube.
