NOTICE OF INTENT TO AWARD A SINGLE SOURCE CONTRACT THIS PUBLIC NOTICE IS NOT A RFP, IFB, OR RFQ Notice Number: AGM-R-19-00015JG This notice is issued in accordance with Federal Acquisition Regulation (FAR) section 5.201 to notify the public of a proposed contract action. Background: The United States Agency for Global Media (USAGM) has a requirement for the services of a local General Manager (General Manager) in Baghdad, Iraq. The General Manager will be accountable to The Commission of Media & Communications (CMC), the local regulator of licensing in Iraq, which requires that the USAGM assign a General Manager as a condition for obtaining a license for the operation of radio and television broadcast operations. Description of Services: The United States Agency for Global Media (USAGM), Office of Management Services/Contracts (CON) located at 330 Independence Avenue, SW., Washington DC 20237, intends to solicit, negotiate, and award a sole source Firm Fixed Price contract to BHC Law Firm, LLC (Contractor) located in Baghdad, Iraq. The NAICS code for this procurement is 515120. The Contractor will be responsible for facilitating licensing activities for the USAGM's broadcast network operations in Iraq as required by the Commission of Media and Communications (CMC) in Iraq. The Contractor will provide the services of a General Manager to facilitate the USAGM's licensing activities pertaining to the USAGM's broadcast network operations in Iraq. The place of performance for this contract will be located in Baghdad, Iraq. The General Manager's responsibilities will be as follows: The General Manager will serve as a liaison between the USAGM and the CMC on matters related to broadcast rules, regulations, and laws in force in Iraq. The General Manager is a requirement of the CMC for broadcast rights in Iraq. The duration of this requirement will be for a period of six (6) months. The estimated dollar value during the period of performance for the General Manager requirement is $30,000.00 in US dollars. The General Manager shall have the ability to communicate in English and Arabic. The statutory authority permitting other than full and open competition for this procurement is 41 U.S.C. 3304(a) which is implemented at FAR 13.106-1as follows: "For purchases not exceeding the simplified acquisition threshold, (i) Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)." The USAGM could not identify any additional potential sources beyond the selected Contractor who can meet the requirements of this procurement. Interested firms shall submit a written response that clearly demonstrates their capability to provide the above requirements. Also, interested firms shall state how they would fulfil the requirement above and include appropriate documentation describing the number of years they have been providing such services. Written responses received from responsible sources shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The anticipated date of award is May 22, 2019.
