Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) DLT is the sole distributor to the Federal Government for the requested software. Purchasing another network management platform is not an option since Solarwinds is institutionalized at SOCOM. To replace the existing network management software with a similar product, such as HP Openview would cost the Government approximately $228,000.00. This figure assumes a cost of $38,000.00 (obtained through internet market research) and multiplied by 6 (the minimum number of licenses needed to operate). This figure does not include the additional cost that would be required to retrain SOCOM personnel on the use of the new system, purchase additional hardware and setup the platform on 3 different networks. In summary, to purchase another brand of network management software would involve substantial duplication of cost that is not expected to be recovered through full and open competition.
