Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) USSOCOM has purchased Primavera-ProSight software, and requires updates and annual maintenance support. Primavera Systems Inc. is the sole manufacturer of the Primavera-ProSight Software and the only company providing maintenance support for the products. The maintenance support provided by Primavera Systems, Inc. will include the current major release of the software or documentation made available during the period and access to Technical Support for trouble shooting and problem resolution while implementing releases in this period. Although there are IT PfM software tools that exist on the market, none have the capability to provide the type of integrated tool that Primavera-ProSight provides in support of IT Portfolio Management, Project Management and Capital Planning and Investment/Earned Value management. In addition, much of the Federal Government to include MILDEPS, COCOMs and Agencies are using Primavera-ProSight as their tool of choice, which provides increased interoperability, data synchronization, and opportunity for re-use, sharing of lessons-learned, developments, and increased synchronization of new PfM efforts at DOD level. Purchasing comparable software from another vendor would result in substantial duplication of costs not expected to be recovered through full and open competition. USSOCOM is implementing this software at a cost in resources to include manpower, time and training. These costs would needed to be expended again in order to test, integrate and install any other software, application or product, as well as, the cost of personnel to gain a level of operational proficiency by USSOCOM employees. Upfront cost for training, data synchronization/data mapping, security permissions/roles development have already been incurred, and would need to be incurred a second time from the start for purchasing/implementing/ developing new software for USSOCOM IT Portfolio Management use, and would require the total reconfiguration of data.
