ADA-compliant Solar Voltaic Powered Comfort Stations with Patented Waste Reduction Systems

THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND NOT A REQUEST FOR PROPOSALS. The National Park Service intends to award a sole source contract using the Simplified Acquisition Procedures to Biological Mediation Systems, LLC for two ADA-compliant Solar Voltaic Powered Comfort Stations with patented waste reduction systems delivered to Lake Meredith National Recreation Area, Fritch, Texas. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Only one contract will be awarded. Authority for this award is 41 U.S.C. 253(d)(1)(A), Unique Source. Currently there are 26 comfort stations in use at Lake Meredith National Recreation Area manufactured by BMS with the patented waste reduction vault evaporator system (patent number 5573661). Utilization of this patented waste reduction evaporator system contained in these units, decreases daily and monthly maintenance and eliminates frequent pumping and cleaning of the vault. This patented technology moves a stream of air throughout the lower vault without batteries or energy from a utility company. As the air flows through the vault, moisture is removed and vented. As a result of this patented technology, solids in the vault dry out rapidly and decrease in size which reduces the need for frequent pumping and vault clean which is a regular activity of vault toilets that do not have this patented waste reduction evaporator system. This patented waste reduction vault evaporator system also provides for a unit that does not stink and is pleasing to the visitors. Maintenance employees at Lake Meredith National Recreation Area have been trained and are familiar with upkeep, repairs and maintenance of the patented waste reduction vault evaporator system that is manufactured by BMS. Holding an extra inventory of parts for a different type of comfort station not manufactured by BMS would not be cost, space or time effective. The item is a one of a kind product which has essential unique design/performance features providing superior utility not obtainable from similar products. Interested parties may identify their capability to respond to this requirement for possible future solicitations. This notice may represent the only official notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
