Contract No. R11PC40028 TAS 14 0680 This J&A is also available at http://www.usbr.gov/mso/aamd/doing-business-acquisitions-noncompetitive.html United States Department of the Interior Class Justification and Approval for OtherThan Full and Open Competition and Waiver of Publication Requirements In accordance with WBR 1401.7001-3 and Electronic Transmittal No. 09-02, the Upper Colorado Region has respectively requested review and approval of a JFOC for electrical service for closed basin pumping project located in the San Luis Valley The request has been prepared and meets all criteria as addressed under FAR part 41.202 procedures, specifically, 41.202(a), whereby it states "if competition for an entire utility service is not available, the market survey may be used to determine the availability of competitive sources for certain portions of the requirement" and FAR part 6.302-1 only one responsible source. There is only one utility company, San Luis Valley rural electric Cooperative with the lines and facilities to supply power to the entire project area. Although it is theoretically possible for another utility to provide power, it must utilize (and pay for) the transmission system of SLRV in order to supply power to the entire project. Making the solicitation available to the other company would not provide for competition, since it must subcontract this component to SLRV at the same time it is attempting to compete with SLRV.
