Special Notice - Notice of Intent to Award a Sole Source Procurement The Department of Veterans Affairs, Veterans Health Administration, Veterans Integrated Service Network (VISN) 17, Network Contracting Office 17, intends to award a firm-fixed priced contract to Baxter Healthcare Corporation for procurement of the following services: 0001: Gambro Prismaflex dialysis equipment maintenance agreement, one (1) year; Unit of Issue: EA, Qty.: Six (6) 1001: Option Year services, CLIN 0001 2001: Option Year services, CLIN 0001 3001: Option Year services, CLIN 0001 The proposed sole source procurement is being made by an open market pricing agreement with Baxter Healthcare Corporation. Baxter Healthcare Corporation has stated that they are the sole distributor for their sales and services and do not contract with third party organizations. Baxter states that there are third party organizations that are certified and trained by Baxter; however, third party organizations performing independently would be liable for any maintenance issues or concerns with the equipment. This notice is not to be considered a request for quotations or proposals. No contract will be awarded on the basis of offers received in response to this notice; however, any offers received may be used to determine if a comparable source is available and more advantageous to the government. If no affirmative written response is received within 5 days from the publication of this notice, a contract will be issued to Baxter Healthcare Corporation without further notice. The anticipated statutory authority permitting other than full and open competition for the requirement is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
