Information-Outreach Booth Exhibit Site Preparation & Logistic Support Services

1. Contracting Agency: Headquarters, Federal Communications Commission, Office of Managing Director, Administrative Operations, Contracts and Purchasing Center, 455 12th Street, SW, Washington, D.C. 20554. In accordance with Federal Acquisition Regulations 6.302-1, the following Justification and Approval (J&A) is submitted for other than full and open competition, which is based on "Only one responsible source and no other supplies or services will satisfy agency requirements." 2. Description of Action: Based on the approval of this J&A, a sole source purchase order-contract using the Government Purchase Card will be awarded to Creative Management Services, LLC d/b/a MC2, Chestnut Ridge, NY.  Description of Supplies/Services: The awarded purchase order-contract will provide for the Pre-show Planning; Exhibit Handling (out and into MC2 facility); Audio/Visual Rental (i.e., 7-flat screen televisions); Labor & Transportation of the FCC Information Booth to be positioned at the NAB 2010 show April 12th through April 15th 2010 at the Las Vegas Convention Center, Las Vegas, NV. 3. Statutory Authority Cited: 41 U.S.C. 253(c) (1) and FAR 6.302-1 (a) (2) (i) "Only one responsible source and no other supplies or services will satisfy agency requirements." 4. Reason For Use of Cited Authority: Use of the authority in paragraph is appropriate when it is necessary to award the contract to a particular source when there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by (1) Unique supplies or services available from only one source or only one supplier with unique capabilities. 5. Efforts to Obtain Competition: MC2 is the contractor who designed and constructed the FCC Information Outreach Booth. As such, they retain proprietary knowledge as to its configuration (i.e., they are owner of the drawings/blueprints) as well as the proper assembly and dismantling. They are responsible for the maintenance and storage of the booth and possess the logistic support teaming arrangements to ensure the booth is relocated to various trade shows throughout the United States with minimum risk of damage or improper assembly. 6. Fair and Reasonable Cost Basis: MC2 provided quotation for logistic support services provided which resulted in a fixed price quote with an estimated value of $44,506.00 This quote is based on no additional services being required during the event. 7. Market Survey: Based on the unique nature and design of the FCC Outreach Information Booth, any repairs that may be required (from relocation mishaps) can only be performed by MC2. This is because MC2 retains proprietary ownership of the drawings/blueprints. 8. MC2 is the "only one responsible source and no other supplies or services will satisfy the agency requirements." 9. Other Factors: This procurement action was required to facilitate the FCC Outreach Booth that provides information to the media community about the potential impact that auctions will have on broadcast licenses and their operations. The booth will also discuss the licensing of broadcast systems. 10. Sources Expressing Interest: None. 11. Actions Taken to Mitigate Additional Non-Competitive Buys: None; the unique nature of this requirement can only be satisfied through a non-competitive procurement.
