Feasibility Study/Proposed Plan/Record of Decision (FS/PP/ROD) at MRS sites at UTTR

Notice of Intent to Sole Source (modification of current contract) in accordance with Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A) "Substantial duplication of cost to the Government that is not expected to be recovered through competition." This is a special notice prepared in accordance with FAR 5.2 - Synopses of Proposed Contract Actions. US Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price modification to URS Group, Inc., on a Sole Source basis. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Feasibility Study (FS)/Proposed Plan (PP)/Record of Decision (ROD) for four (4) Munitions Response Sites (MRSs) (TG509, TG511, XU512, and OD513) and No Further Action (NFA) documentation including NFA PP, NFA ROD, and NFA Explosives Safety Submission (ESS) for six (6) MRSs (TG507, OD508b, TG509a, TG511b, OD513b, and XU512b). Description of work: The Contractor will complete an FS for four (4) MRSs (TG 509, TG511, XU512, and OD513) that presents remedial action objectives (RAOs) and general response actions, identifies and screens technologies, assembles selected technologies and process options into remedial alternatives, and evaluates those alternatives using the National Contingency Plan (NCP) criteria. Remedial alternative cost estimates shall be presented in the FS. The alternatives will consider a range of response actions, remedial technologies, and process options, including no action (as required by the NCP), land use controls (LUCs), means to reduce or eliminate toxicity, mobility, or volume of contamination or waste, innovative technologies, monitored natural attenuation, and protection from explosives safety hazards. The FS must also recommend a preferred alternative. The Contractor will prepare a PP for four (4) MRSs (TG509, TG511, XU512, and OD513) that provides a summary background, site conditions, FS results, rationale for selected remedy, and a description of the proposed remedial action (RA) goals and associated rationale. Similarly, the Contractor will prepare a separate NFA PP for six (6) MRSs (TG507, OD508b, TG509a, TG511b, OD513b, and XU512b) that provides a summary background, site conditions, and rationale for the NFA recommendation. After gaining Government and Utah Department of Environmental Quality (UDEQ) acceptance, submit the final PPs for public comment and present it at a scheduled and advertised public meeting. Prepare meeting transcripts that include a Responsiveness Summary to address issues raised by the public for incorporation into the ROD. The Contractor will prepare and gain acceptance of a ROD to document the selected remedy for four (4) MRSs (TG509, TG511, XU512, and OD513). Similarly, the Contractor will prepare a separate NFA ROD for six (6) MRSs (TG507, OD508b, TG509a, TG511b, OD513b, and XU512b) that documents the NFA as the selected remedy for these MRSs. The RODs will include a description of land use and exposure scenarios and will demonstrate how the selected remedies will meet regulatory requirements. The environment where this requirement will be performed includes harsh, remote desert terrain that is difficult to access without proper equipment and training. The work involves multiple disciplines including UXO, engineering, geology, environmental, construction, and archaeology. Work in this environment requires sufficient infrastructure to facilitate mobilizing the necessary resources and equipment to complete the required investigation and remediation. In addition, UTTR mission activities necessitate close scheduling coordination and require that work schedules maintain a strict timeline. This project requires a Utah-licensed Principal Investigator and other archaeologists to oversee and implement the cultural resource requirements. The archaeologists are required to provide on-site monitoring during fieldwork and to complete archaeological surveys and recordation of all cultural resources encountered. The current Contractor has a team in place that has completed the remedial investigation on the above sites with the necessary personnel, expertise, and safety protocols to contend with the remote and austere conditions while conducting remediation activities. The current archaeologists developed the approved cultural resources approach, and understand both the prehistoric and historic context of the area. The current Contractor is deployed to this remote location, has established essential communications, and obtained the security clearances required for access to the UTTR. Their personnel have completed all requisite training and possess current approvals required to access the sites. Authority: The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii) -For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in-- (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition Solicitation of this requirement would create substantial duplication of cost to the Government that is not expected to be recovered through competition. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the Government.
