Notice of Intent to Award a Sole Source Purchase Order for Document Digitization

It is the intent of this agency to award a sole source purchase order using the Simplified Acquisition Procedures (FAR Part 13 and FAR Part 12) to Discover-E Legal (formerly Pacific Legal, Inc.) of Portland, OR, for the conversion of paper and electronic documents into a uniform, labeled set of digitized documents in TIFF file format, ready for placement into a searchable database. In addition, the contractor will add codes reflecting document information, including bates numbers, document dates, document type and title as required. The IRS, U.S. Attorney's Office, and the legal defense team are working on a specific case and have contracted with this vendor for litigation support services thus far. Only by contiuing to obtain scanning services available from Discover-E Legal can the IRS, U.S. Attorney's Office and the legal defense team ensure consistency of quality and format between those documents already scanned and those to be scanned. Any inconsistency in methodology could impact the evidentiary value of the scanned material. Per FAR 13.106-1(b)(1), the Contracting Officer has determined that the continued use of this vendor is in the best interest of the Government. A Sole Source Justification – Simplified Acquisitions has been completed and is attached to this notice. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by Thursday, December 16, 2010 will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
