R--INTENT TO SOLE SOURCE TO: Motion Picture Licensing Corporation (MPLC) FOR: Authorizing PUBLIC PERFORMANCE OF MOTION PICTURES at all VA Medical Centers

Veterans Health Affairs, Network Contracting Office 5, is issuing this Notice of Intent to Sole Source in order to identify any potential sources that have the resources, rights, and capabilities to grant the Department of Veterans Affairs non-exclusive licensing to publicly perform copyrighted motion pictures and other audiovisual programs intended for personal & private use only. SERVICES REQUIRED The US Department of Veterans Affairs has utilized Motion Picture Licensing Corporation (MPLC) as a sole source vendor since 1990. Since the 1990 s, VA has negotiated a special agreement with MPLC which allows all medical centers to use home videocassettes. Without a license, a Department of Veterans Affairs Medical Center (VAMC) showing home videocassettes puts the VA, as well as the local center, at risk of being liable for copyright infringement. The license agreement authorizes PUBLIC PERFORMANCE OF MOTION PICTURES covered under this agreement at all Department of Veterans Affairs Medical Centers. It is understood and agreed that the sole purpose of such public performance is to exhibit for entertainment and educational purposes. Under this agreement, VA personnel can rent, purchase or borrow videocassettes produced by MPLC s over 40 studios and producers, and show them via a closed-circuit system or anywhere within the medical center. Also, when new titles become available, they are automatically covered and may be shown in a VHA facility. This is the only known vendor available for this expansive use of video, movie and audio files that is covered under umbrella license for facilities use. Ref.
