NOTICE OF INTENT TO SOLE SOURCE - STERILITY MEDIA SUPPLIES THERMO FISHER

The Centers for Disease Control and Prevention intends to award a sole source firm fixed price purchase order to Thermo Fisher for the products listed in the attachment. The products are all available from the contractor and are available using pre-qualified materials. Although companies other than Thermo Fisher Scientific create the products or re-sell the products, they do not carry everything needed by the CDC with the same formula required by the CDC. Some vendors carry bulk containers of the items; however, the recipes are slightly different and will not work for the CDC processes. They have not been approved by the Influenza Division sterility media protocol. The reagents used from Fisher to characterize influenza viruses have been tested and qualified and are regulated by the CDC’s standard operating procedures (SOP) and quality protocols. There is no other vendor who can provide the entire required list with the required ingredients. Additionally, the work needed to achieve CDC’s goals requires all products listed at the same time which is more difficult to regulate when ordering from multiple vendors. Sole sourcing all products from Fisher allows consistent quality and expiry dates across multiple products. This contract action is for supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) (SAP) and 10 U.S.C. 2304(c)(1). Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotations; however, all quotations/responses received within fifteen days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
