The Pacific Regional Contracting Office at Tripler Army Medical Center (TAMC), Hawaii, intends to make a sole source award to Biomerieux, Inc. for the purchase of Biomerieux Reagents. TAMC currently uses the Biomerieux VITEK2 Bacterial Analyzer and BacT Alert 3D systems and has established rigorously validated SOPs and proven diagnostic accuracy with providers and accrediting agencies. Therefore, these reagents are the only ones that can meet the Government's current need. Biomerieux products are sold and distributed exclusively. The statutory authority permitting this award without providing full and open competition is 41 U.S.C. 1901, as cited in FAR 13.501(a)(1)(ii), which authorizes the government to award contracts when there is only one responsible source and no other suppliers or services will satisfy agency requirements.
