1. The Millennium Challenge Corporation ("MCC") and the Government of Benin (the "Government" or "GoB") have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Benin (the "Compact") in the amount of three hundred seventy-five million United States Dollars (375 000 000 USD), ("MCC Funding"). The Government, acting through Millennium Challenge Account-Benin II (the "MCA Entity"), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Invitation for Bids (IFB) is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government and the MCA-Benin II shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. 2. The Benin Power Program consists of four (4) Projects: (i) Policy Reform and Institutional Strengthening Project; (ii) Electricity Generation Project; (iii) Electricity Distribution Project; and (iv) Off-grid Electricity Access Project. The objective of the program is to increase the productivity and production for businesses, generate more economic opportunities for households and improve the capacity to provide public and social services by improving the quantity and quality of power supply. The Compact Program will be executed over a period of five (5) years upon the Compact Entry into Force (EIF). The Power Compact of Benin entered into force on June 22, 2017. This IFB is part of the activities under the Compact Electricity Distribution Project. 3. This IFB follows the Compact General Procurement Notice N°4 that appeared in dgMarket on April 12, 2019, UNDB Online on April 16, 2019 and on the MCA Entity website www.mcabenin2.bj on April 15, 2019, and the local newspaper "la Nation" and "le Matinal" on April 18 and 25, 2019. 4. MCA-Benin II, acting on behalf of the Government of Benin, now invites Bidders to provide their best offer for works related to the "Reinforcement and Rehabilitation of the Electricity Distribution Network in Cotonou and at the Regional Level - Substations". More details on these works and related services are provided in the Section VII ("Employer's Requirements") of the current bidding documents. 5. The IFB is open to all eligible entities ("Bidders") who wish to respond. 6. The procurement comprises of the following three lots: • Lot A, representing the Design-Build of substations of the 161/63/33/20/15 kV at regional level and of some substations around Cotonou (substations of Natitingou, Bérincigou, Djougou, Parakou, Bohicon, Maria Gléta, Vèdoko and Sèmè); • Lot B, representing the Design-Build of the 63 and 15 kV substations at Cotonou (substations of Gbedjromèdo, Croix Rouge, Cim Bénin and Akpakpa); • Lot C, representing the Design-Build of substations of the 63 and 15 kV at Cotonou (substations of Aéroport, Fidjrossè, Ancien Pont and Tanzoun); The lots are indivisible. The Bidder may submit an offer for one or more lots at a time. 7. A Bidder will be selected using the Quality and Price Based Selection (QPSB) method as part of Open Bidding procedures, described in the relevant sections of the Bidding Document accompanying this Specific Procurement Notice. Bidders are informed that these procedures are governed by MCC Program Procurement Guidelines (PPG") which can be found on the MCC website: www.mcc.gov. Although these procedures are similar to those set out in the World Bank Standard Bidding Documents for procurement of works, there are several significant differences and firms are advised to review these instructions carefully. 8. The complete set of the Bidding Document, including the Letter of Invitation, the Employer's Requirements and the drawings will be made available to the interested Bidders after registration, via electronic download. Additionally, following registration, the same complete set of the Bidding Document on a CD may be obtained from the Procurement Agent of the Millennium Challenge Account - Benin II, at its premises located at the address specified below. 9. The Bidding Document includes the following Sections: Section I: Instructions to Bidders: This section provides information to help Bidders prepare their Bids and describes the procedures for the submission, opening, and evaluation of Bids and the award of Contracts; Section II : Bid Data Sheet: This section sets out the particular requirements for the specific procurement and supplements the information included in Section I, Instructions to Bidders; Section III : Bid Review, Evaluation Criteria, and Bidder Qualification Requirements: This section describes the criteria and requirements to determine the lowest evaluated responsive Bid and the qualifications of the Bidder to perform the Contract; Section IV: Bidding Forms: This section provides the forms which are to be completed by the Bidder and submitted as part of its Bid ; Section V: Employer's Requirements: This section contains the volumes of information that more fully describe the Works to be designed and constructed and includes the Schedule of Prices, Employer's Requirements and the Drawings; Section VI : General Conditions of Contract ("GCC"): This section contains the form of Contract to be entered into by the MCA Entities for the design and construction of Design-Build projects; Section VII: Particular Conditions of Contract ("PCC"): This section contains particular conditions of contract that have been developed by MCC to supplement the GCC and that shall be used by the MCA Entities in contracting for Design-Build. Section VIII: Form of Notice of Intent to Award: This section contains the form of Notice of Intent to Award to be used by the MCA Entity to notify the successful Bidder that the MCA Entity anticipates awarding the Contract to, upon the expiration of the period for timely filing of bid challenges and the resolution of any bid challenge that may be submitted; Section IX: Annex to the Particular Conditions - Contract Forms: This section contains forms which, once completed, will be part of the Contract. 10. A Site Visit and a Pre-Bid meeting will be held as described in the Bid Data Sheet ("BDS"), Section II of the Bidding Document. All Bids must be accompanied by a Bid Security in the form and amount specified in the BDS. 13. The closing date and time for receipt of Bids is July 29, 2019 at 10:00 a.m. (Benin time).
