This is a combined synopsis/solicitation for commercial supplies prepared in accordance with the format in FAR 12.6 as supplemented with FAR 8 and additional information included in this notice. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-06. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND A SEPARATE SOLICITATION WILL NOT BE ISSUED. The Government intends to issue a Firm Fixed Price Task Order. Set Aside: Small Business NAICS Code: 325120 Background: This is a non-personnel service contract to provide laboratory gases and liquefied laboratory gases and services as specified in this Statement or Work (SOW). The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. Objectives: The U.S. Food and Drug Administration, Forensic Chemistry Center’s (FCC) mission is to protect the public health by providing analytical approaches, rapid development of methodology and expert scientific evaluations in support of investigations involving the safety of foods, drugs and other FDA regulated products. The Government requires various laboratory gases contained in cylinders, liquefied laboratory gases contained in rolling dewars, and bulk liquid gases contained in outside bulk storage tanks with gas fill-up service. The required laboratory gases and liquefied gases are used to perform the routine and ongoing critical analyses to provide a rapid response capability for investigations and other evaluations in support of our mission stated above. Without the required laboratory gases and liquefied gases, the FCC cannot complete its mission in protecting public health and welfare. Scope/Requirements/Deliverables: The Contractor shall provide all resources necessary to accomplish the tasks and deliverables described in this Statement of Work (SOW). Tasks and Minimum Requirements The Government requires various laboratory gases on an “as needed” basis, as requested by the Contracting Officer’s Representative (COR) or designated representative. Laboratory gases shall be contained in cylinders, liquefied laboratory gases contained in rolling dewars, and liquid gases contained in bulk storage tanks of Liquid Nitrogen and Liquid Argon with gas fill-up service. The delivery and pick-up location will be at the FCC laboratory in Cincinnati, Ohio. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, documentation, supervision, and other items and non-personal services necessary to provide the required laboratory gases and liquefied gases as defined in this SOW. The Contractor shall perform to the standards and requirements listed in details below: The Contractor shall at minimum be ISO/IEC 17025 accredited and shall present a current certificate of accreditation to the COR no later than ten business days after contract award. The Contractor shall safely deliver orders of bulk gases, cylinders, and rolling dewars and retrieve empty cylinders and rolling dewars from the FCC Laboratory. The Contractor shall abide by the Department of Transportation (DOT) guidelines and requirements for the safe transport of gases/cylinders. The Contractor shall label any cylinders without DOT stickers. Contractor shall have stickers available to remove cylinders from Government facility. All cylinders shall be labeled in accordance with applicable Federal and State regulations. All cylinders shall be hydrostatically tested and inspected as required by CGA, Federal, and State regulations. The Contractor shall be available for delivery requests and provide technical support by telephone Monday through Friday, excluding federal holidays, between 8:00 AM and 4:00 PM Eastern Time. The Contractor shall deliver requested items within 48 hours after receiving the TPOC’s request or on a day as specified by the TPOC for normal/standard service. Delivery shall only be on Monday through Friday, excluding federal holidays, between 8:00 AM and 4:00 PM Eastern Time. Delivery personnel shall notify the TPOC prior to delivery to ensure processing. Orders for cylinder and rolling dewars shall be delivered in one shipment unless otherwise agreed by the TPOC at the time of his request. Delivery of bulk Argon and Nitrogen may be delivered separately. When delivering laboratory gases contained in cylinders and liquefied lab gases in rolling dewars, the Contractor shall have the ability to off-load onto a 4’-6” dock. Gas cylinders and rolling dewars shall be delivered and properly secured in the designated gas storage location in the dock area. The Contractor shall also pick up empty gas cylinders and rolling dewars at the same location during deliveries. The Contractor shall provide appropriately sized bulk tanks for both Liquid Argon and Liquid Nitrogen. The Liquid Nitrogen bulk tank system shall be capable of providing UHP Liquid Nitrogen (99.999%) gas at a minimum of 180 psi at the tank and maintain that pressure inside the laboratories. The Contractor shall notify FDA prior to filling the Liquid Nitrogen tank by trans-fill from Liquid Nitrogen dewars instead of the normal delivery truck. The Liquid Argon tank system must be stainless steel and capable of providing Argon gas at a minimum pressure of 150 psi. The Argon gas shall meet or exceed to following specifications: Purity greater than 99.998% with less than 10ppm water and less than 10ppm Oxygen. The bulk tanks shall be installed on the existing, Government-owned concrete pads. Pad A for the nitrogen tank has the dimensions of 17'-0" x 17'-0" x 1'-9" with a step up of 6” to 11”and is capable of supporting up to a 9,000-gallon vertical tank. A minimum 6,000 gallon vertical tank is required. Pad B for the argon tank has the dimensions of 12’-6” x 13’-0” and is capable of supporting up to 4,000 PSF. A minimum 1,000 liter stainless steel tank with stainless steel fittings is what is needed for the lab to accommodate monthly fills. Bulk tanks shall be installed, filled, and ready to operate at a date agreed upon by the TPOC, but no later than 30 days after contract award. Contractor will coordinate with previous contractor to minimize disruption to service and complete installation. The tanks shall be installed to current fittings and regulators located at the two concrete pad locations. Contractor may schedule appointment to inspect area prior to bidding. Contractor responsible to obtain any drawings or specifications necessary to complete installation. The supplier will monitor the levels of the bulk tanks to ensure the fill level does not drop below 30% and contact the COR or his designated representative to schedule delivery within 24-48 hours. The Contractor shall provide on-site technical support within 24 hours of a service request. Replacement of defective gas cylinders and dewars shall be provided at no charge the same day or as specified by the TPOC. All gases are to meet or exceed MIL SPECS where applicable.
